1. Definitions

Foxphoria refers to the AI image generation platform, including its website, software, services, and related systems. It may also refer collectively to the developers and operators of the platform where applicable.

The App means the Foxphoria interface available through Discord, web portals, or other authorized platforms.

You or User refers to any individual or entity who accesses or uses Foxphoria.

Foxbits are the virtual currency used within Foxphoria. They have no real-world monetary value and cannot be refunded or transferred outside the App.

2. Age Requirement

You must be 18 years of age or older to use Foxphoria ("the App"). By using the App, you affirm that you meet this age requirement and accept full responsibility for the content you may encounter and create.

3. Acceptance of Terms

By accessing or using Foxphoria, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the App.

4. Nature of AI Artwork

Foxphoria generates AI-based artwork that is inherently random and uncurated. While we strive to offer high-quality outputs, we do not guarantee results will meet personal, professional, or legal expectations.

5. Use of Generated Artwork

You may use artwork generated by Foxphoria for personal and commercial purposes. However, you acknowledge that the App's outputs are unpredictable and that you are solely responsible for how they are used. You agree not to depend on Foxphoria-generated content for critical, legal, or sensitive applications.

6. Intellectual Property

All intellectual property rights in and to Foxphoria, including but not limited to its software, branding, and structure, remain the property of Foxphoria. This does not extend to the AI-generated images themselves, which are provided without exclusivity or ownership guarantees.

7. User Responsibility for Copyrighted Material

Foxphoria does not monitor or control the prompts entered by users or the content generated. If you generate, use, or distribute content that involves copyrighted or trademarked materials, you do so at your own risk. You are solely responsible for ensuring compliance with applicable laws. Foxphoria disclaims all responsibility and liability related to the misuse or illegal use of generated content, including infringement of intellectual property rights.

8. Limitation of Liability

Foxphoria is provided "as is" and "as available." To the fullest extent permitted by law, Foxphoria and its developers disclaim all warranties, express or implied. Under no circumstances shall Foxphoria be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including but not limited to loss of data, content, or profits, arising from the use of the App. Use of Foxphoria is at your own discretion and risk.

9. Content Responsibility

All content generated using Foxphoria is the sole responsibility of the user. We do not vet, endorse, or assume liability for any material created using the App. You are fully accountable for the legality, appropriateness, and consequences of your use of generated content. Foxphoria does not and cannot advocate or condone any unlawful, harmful, or offensive use of its services.

10. Adult-Themed Artwork Disclaimer

Due to the complexity and unpredictability of AI models, Foxphoria may unintentionally generate content that is explicit, suggestive, or otherwise unsuitable for all audiences, even in the absence of explicit user input. While efforts are made to reduce such occurrences, they cannot be fully prevented.

By continuing to use Foxphoria, you confirm that you are at least 18 years of age and acknowledge that you may be exposed to such content. You assume full responsibility for the use of the App and agree that Foxphoria shall not be held liable for any such content.

11. Foxbits (App Currency)

Foxbits are a virtual currency used exclusively within Foxphoria. They are non-transferable, non-refundable, and hold no real-world monetary value. Foxphoria may modify or discontinue the Foxbit system at any time without prior notice or liability.

12. Changes to Terms

Foxphoria may update these Terms of Service at any time. You’ll be prompted to accept any changes before continuing to use the App.
